GENERAL TERMS AND CONDITIONS OF SALE
The offer and sale of products on the website shop.plantsnature.it and affiliated websites are governed by the following general terms and conditions of sale. The products purchased on the website are sold by Ti.Nature s.r.l., with registered office at Via San Paolo Belsito, 32 – 80035 Nola (NA), VAT no. 08327741214, REA no. NA-949045.
The terms and conditions of sale are deemed to be known by the Customer at the time of purchase. Therefore, each order implies implicit acceptance thereof. These general terms and conditions may be updated or modified at any time by Ti.Nature s.r.l., which will update the relevant pages on the website accordingly.
OBJECT OF THE CONTRACT
The offer and sale of products on the website shop.plantsnature.it and affiliated websites constitute a distance contract governed by Articles 50 et seq. of Legislative Decree of 6 September 2005, no. 206 (Consumer Code), as well as by Legislative Decree of 9 April 2003, no. 70 (E-Commerce Law).
ORDER ACCEPTANCE AND CONCLUSION OF THE SALES CONTRACT
By submitting a purchase order, the Customer declares to have read and accepted these terms and conditions of sale as well as the additional information provided on the website. The contract shall be deemed concluded, and binding on both parties, only when the Customer receives notification of shipment.
PRODUCTS AND SALES PRICES
All sales prices of the products listed on the website shop.plantsnature.it and affiliated websites include VAT and any other applicable taxes, but exclude shipping costs, which are indicated separately. Prices constitute a public offer pursuant to Art. 1336 of the Italian Civil Code. It is understood that product images accompanying product descriptions may not be perfectly representative of their characteristics and may differ in color, size, or any accessories shown in the pictures.
PAYMENT METHODS
At the time of purchase, the Customer may choose to pay via PayPal or Cash on Delivery.
For PayPal payments, the Customer will be redirected to the PayPal website to complete the transaction using any accepted credit card or their PayPal account. PayPal manages the payment data directly through its platform. Ti.Nature s.r.l. does not collect any data relating to the Credit Card used or access codes for the “PayPal” payment method. This information is collected directly by PayPal’s systems.
For Cash on Delivery payments, the Customer must pay an additional handling fee of €5.00 (VAT included), charged by the courier service. Payment must be made in cash directly to the courier upon delivery.
FISCAL CERTIFICATION AND INVOICES
Invoices for products purchased by private customers are not issued, as such transactions are not subject to the obligation of fiscal certification pursuant to Article 22, paragraph 1, no. 1 of Presidential Decree 633 of 1972 and Article 2 of Presidential Decree 696 of 1996. All customers receive an order summary, which holds the same fiscal and legal value as a traditional receipt.
PROVISION AND PROCESSING OF PERSONAL DATA
The Customer’s personal data is collected for the purpose of executing the purchase contract and shipping the orders received. Such data is processed electronically in compliance with applicable laws and may only be disclosed upon request of judicial authorities or other legally authorized entities. Personal data will be shared with parties responsible for carrying out the necessary activities for the performance of the contract and disclosed solely within this purpose.
The Customer expressly undertakes to provide Ti.Nature s.r.l. with copies of identity documents deemed necessary for any verifications. Failure to comply with this request entitles Ti.Nature s.r.l. to immediately terminate the contract due to non-performance.
Data processing is carried out, including by electronic means, in compliance with the procedures set forth in Art. 11 of Legislative Decree of 30 June 2003, no. 196, guaranteeing the user’s rights, fundamental freedoms, and dignity, with particular regard to privacy and personal identity. Processing will be carried out for no longer than is strictly necessary for the purposes described above.
The deletion of personal data is subject to the sending of a written communication to Ti.Nature s.r.l., the data controller and processor, with registered office at Via San Paolo Belsito, 32 – 80035 Nola (NA), Italy.
APPLICABLE LAW AND JURISDICTION
The contract between Ti.Nature s.r.l. and the Customer is governed by Italian law. For any dispute arising between the parties concerning this contract, the Court of Naples shall have exclusive jurisdiction.
